FENCE RULES – ATLANTA (CITY), GEORGIA

Residential fences are permitted on private property within City of Atlanta, subject to local regulations.
In City of Atlanta, residential fence rules are not gathered into one standalone fence chapter. GOVERNANCE
The governing authority is the City of Atlanta. Fence regulation and review are administered through the Department of City Planning.
The Office of Zoning & Development handles zoning compliance. The Office of Buildings issues building permits and handles inspections. The Office of Design, including the Historic Preservation Studio, handles regulation and compliance within the city’s historic and landmark districts.
The City of Atlanta does not publish a single consolidated residential fence code. Standard residential fence rules appear primarily in Section 16-28.008 of the Atlanta Land Development Code, with additional historic-district approval rules in Chapter 20, fee treatment in Appendix B, and sidewalk-adjacent safety controls in Section 138-10.
PERMIT AND APPROVAL REQUIREMENTS
• Building Permit: A Building Permit is required for standard residential fences in City of Atlanta. City Planning identifies fences as commonly permitted projects and publishes separate permit fees for fences 6 feet or less and fences over 6 feet. The official sources compiled for this page do not publish a height-based fence permit exemption.
• Zoning Compliance: Building permit requirements are separate from zoning, setback, or plat requirements. Confirm any applicable zoning conditions, setbacks, and plat requirements with the Office of Zoning & Development before construction.
• Greater Fence Height: A fence that exceeds the height otherwise allowed in a required yard must be approved by special exception through the Board of Zoning Adjustment.
• Historic and Landmark Districts: Chapter 20 requires a Certificate of Appropriateness for exterior appearance changes and for new structures within designated landmark and historic districts. City Planning also states that district and overlay location can trigger additional review before building permit submission.
FENCE PLACEMENT RULES
• Required Yards: Section 16-28.008 allows fences, walls, and hedges within required yards, subject to the height limits and visibility limits stated in the zoning ordinance.
• Property Lines: The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements.
• Utility Safety: Georgia law requires notice to the Utilities Protection Center (Georgia 811) before excavation with mechanized equipment. The locate request effective date must be not less than two (2) business days and not more than eight (8) business days after the request is received, and work under that locate request may not begin more than 30 calendar days after the effective date.
FENCE HEIGHT AND VISIBILITY RULES
• R-1 through R-5 Front and Half-Depth Front Yards: Fences not exceeding 4 feet in height may be erected.
• R-1 through R-5 Side and Rear Yards: Fences or walls not exceeding 6 feet in height may be erected or maintained.
• R-G Front Yards: Fences not exceeding 4 feet in height may be erected in the front yard.
• R-G Side and Rear Yards: Fences or walls not exceeding 8 feet in height may be erected or maintained in the side or rear yards.
• Street Intersections in Dwelling Districts: No fence or wall exceeding 2.5 feet in height may be erected or maintained within 20 feet of any street intersection, measured from the grade at the intersecting street right-of-way lines.
• Visibility Triangles: In districts where yards are generally required adjacent to streets, nothing may be erected, placed, planted, or allowed to grow so as to materially impede visibility between 2.5 feet and 8 feet above grade within the required visibility triangle at street intersections and driveway intersections.
MATERIAL AND CONSTRUCTION LIMITS
• General Materials: The code does not publish a general approved-material list for standard residential fences citywide.
• Condition: Fences, walls, and hedges in required yards must be maintained in a safe and sightly condition.
• Dangerous Fence Types Along Sidewalks: Along the portion of a lot adjacent to a public right-of-way sidewalk, barbed wire fences, electric fences, and other fence types or objects that endanger passersby are unlawful unless protected by a barrier approved by the transportation authority or placed at least 3 feet from the inside edge of the sidewalk on private property.
PRIVATE RESTRICTIONS
Private covenants, deed restrictions, and homeowners association rules operate independently of the City of Atlanta code and may be more restrictive than city requirements.

• Permit Review and Inspection: Fence work that requires a permit is reviewed by the Office of Buildings and is subject to inspection procedures.
