FENCE RULES – DULUTH (CITY), GEORGIA

OVERVIEW

Residential fences are permitted on private property within City of Duluth, subject to local regulations.

GOVERNANCE

The City of Duluth regulates residential fences through the Duluth Unified Development Code and the City of Duluth Code of Ordinances.

The Community Development & Engineering Department administers planning, permits, inspections, and code compliance. The official city materials also refer to the Planning and Development Division, the Planning and Development Department, the Planning and Development Director, and the Building Official in connection with ordinance administration, approvals, and permits.

City of Duluth does not place all fence rules in one standalone fence chapter. Instead, the controlling residential standards are spread across UDC Section 304.02, Table 12-A: Special Exceptions, and Sec. 5-223 of the property maintenance ordinance.

PERMIT AND APPROVAL REQUIREMENTS

Building Permit: The official permit page states that most construction work in the City requires a permit from the Planning and Development Department.

Front Yard Residential Fence Approval: A fence within the required front yard in a residential district is tied to a special exception process under Table 12-A. For administrative approval, the application must include fence documentation and a property survey, and the fence must meet the published design limits.

Administrative Front Yard Height Exception: Within the required front yard, the published standard is 4 feet. The code allows administrative approval for a decorative front-yard fence up to 5 feet when the published conditions are met.

Retaining Walls: Retaining walls exceeding 3’11” in height require a separate review and permit.

FENCE PLACEMENT RULES

Property-Line Setbacks: The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements.

Front Yard Location: Fences located within the required front yard must comply with the front-yard decorative-fence standards in UDC Section 304.02 and the administrative approval parameters in Table 12-A.

Sight Distance: No fence may obstruct site distance. If fence height creates a site-distance obstruction, the fence must be pushed back toward the principal structure until the obstruction is removed.

Residential Development Plans: For residential development projects, an overall fencing plan must be submitted for review and approval by the Planning and Development Director before development permits are issued.

Utility Safety: Georgia law requires notice to the Utilities Protection Center (Georgia 811) before excavation with mechanized equipment. The locate request effective date must be not less than two (2) business days and not more than eight (8) business days after the request is received, and work under that locate request may not begin more than 30 calendar days after the effective date.

FENCE HEIGHT AND VISIBILITY RULES

Side and Rear Yards: No wall or fence may exceed 8 feet in height within a side yard or rear yard.

Front Yard: No wall or fence may exceed 4 feet in height within a front yard, except where the published administrative approval path allows a decorative front-yard fence up to 5 feet.

Front Yard Decorative Fence Visibility: Front-yard decorative fences may not obstruct site distance. If visibility is obstructed, the fence must be moved back toward the principal structure until the obstruction no longer exists.

MATERIAL AND CONSTRUCTION LIMITS

Front Yard Decorative Fence Materials: Within the required front yard, fences must be constructed with natural wood, simulated wood, brick columns, or decorative ornamental iron.

Picket Spacing: The distance between the pickets of a picket fence must be a minimum of 2 inches.

Front Yard Color Limits: Front-yard fence colors must be natural wood tones or neutral colors such as white, beige, ivory, cream off-white, or black, dark green wrought iron, or the same color as the façade of the principal structure.

Front Yard Privacy Fences: Solid panel or privacy fences are not allowed within the required front yard.

Electric Fencing: Electric fencing is prohibited, except for invisible fencing used to contain domestic animals on the property.

Retaining Wall Materials: Retaining walls must be constructed of interlocking masonry block, brick, or other decorative material as approved by the Planning and Development Director. Timber walls are prohibited.

Maintenance Standard: Fences must be maintained in a structurally sound condition, in good repair, and free from loose, missing, or rotting materials. If painted, paint must be maintained without peeling, chipping, or fading. Fences must also be kept clean and free of visible mold, mildew, or algae growth.

PRIVATE RESTRICTIONS

Homeowners’ associations, subdivision covenants, and other private restrictions operate independently of City of Duluth regulations and may be more restrictive than the city’s published fence rules.

REVIEW AND ENFORCEMENT CONTEXT

Fence issues are typically reviewed during permit or approval review when required, and through complaint-based code enforcement. Examples include:

Front Yard Review: A fence proposed within the required front yard in a residential district may require special exception review and must satisfy the published administrative approval parameters if that path is used.

Height Review: Fence height is reviewed against the published limits of 4 feet in the front yard and 8 feet in the side or rear yard.

Visibility Review: A fence that obstructs site distance must be relocated farther back toward the principal structure until the obstruction is removed.

Retaining Wall Review: Retaining walls exceeding 3’11” are subject to separate review and permit requirements.

Maintenance Enforcement: Under Sec. 5-223, fences and walls must remain structurally sound and in good repair, and under UDC Section 304.02, fences must remain free from loose, missing, or rotting materials and related visible deterioration.

Complaint-Based Enforcement: The official code-compliance materials identify fences or walls in disrepair and building or demolition without a permit as common reported violations.
