FENCE RULES – ALPHARETTA (CITY), GEORGIA

GOVERNANCE

The governing authority is the City of Alpharetta. Residential fence standards are primarily governed by the Unified Development Code, with supplemental visibility regulation in the Alpharetta City Code.

Administration appears to run through the Community Development Department, including Planning & Zoning, Construction & Inspections, and Code Enforcement.

City of Alpharetta does have a dedicated fence standard in the Unified Development Code, but fence rules are not confined to one source. Permit administration is also addressed through the City’s official Community Development guidance, and street-entry visibility is addressed in the City Code.

PERMIT AND APPROVAL REQUIREMENTS

Building Permit Threshold: A Building Permit is not required for standard residential fences 6 feet in height or lower, as stated in the official sources compiled for this page.

Over-Height Fences: Official City guidance states that fences over 6 feet tall require a permit and inspections.

Zoning Compliance: Building permit requirements are separate from zoning, setback, or plat requirements. Confirm any applicable zoning conditions, setbacks, and plat requirements with Planning & Zoning before construction.

FENCE PLACEMENT RULES

• The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements.

Street Intersections and Driveways: No wall, fence, shrubbery, or hedge over 3 feet in height may be located within 20 feet of an intersection of two or more streets or within 10 feet of the edge of a driveway leading to a street.

Landscape Strips and Buffers: Fences and walls must be placed at least 5 feet from required landscape strips and buffers unless approved otherwise at a public hearing.

Public or Private Right-of-Way: A privacy fence or chainlink fence along a public or private right-of-way is permitted only when the required landscape strip and associated landscape material is provided.

Front Yard Placement: Privacy and chainlink fences are prohibited in a front yard. The Director of Community Development, or designee, may approve a privacy fence in the front yard on collector or arterial streets.

Public Multi-Use Trails: A fence or wall along a public multi-use trail must be set back at least 10 feet from the trail, must not be opaque, and must not exceed 5 feet in height.

Street Entrance Visibility: The Alpharetta City Code prohibits erecting a fence or other device that obstructs the clear view of an adjacent land owner entering or exiting a street.

Utility Safety: Georgia law requires notice to the Utilities Protection Center (Georgia 811) before excavation with mechanized equipment. The locate request effective date must be not less than two (2) business days and not more than eight (8) business days after the request is received, and work under that locate request may not begin more than 30 calendar days after the effective date.

FENCE HEIGHT AND VISIBILITY RULES

Residential Height: Fences and walls used as fences may not exceed 6 feet on residential property.

Sloped Lots: The height limit may be exceeded by up to 50 percent on sloped lots where the appearance of an even fence line is desired.

Visibility Triangle Rule: No wall, fence, shrubbery, or hedge over 3 feet in height may be placed within 20 feet of a street intersection or within 10 feet of the edge of a driveway leading to a street.

Street Entrance View Obstruction: Separate from the distance-based rule above, the Alpharetta City Code prohibits fences or hedges that obstruct the clear view of adjacent land owners entering or exiting a street.

MATERIAL AND CONSTRUCTION LIMITS

Allowed Materials: Fences and walls used as fences may be made of wood, metal, brick, block, vinyl, or stone. Wood must be protected from decay by using naturally durable wood or pressure-treated wood.

Prohibited Materials: The use of plywood or sheet goods as fencing material is prohibited.

Restricted Wire and Electric Fencing: Barbed wire, razor wire, or electrically charged fencing is permitted in AG and RE districts and may be permitted in other districts only through administrative review and approval.

Finished Side: Fencing must be constructed with the finished side facing away from the owner’s property.

Color and Visual Character: Fences and walls used as fences may not be finished with bright or primary colors or be visually distracting in any other way.

PRIVATE RESTRICTIONS

Private covenants, deed restrictions, and HOA rules operate independently of City of Alpharetta regulations and may be more restrictive than the local code.
